Overview
David Varty has acted for clients in Technology, software development, copyright and trademark law since 1983. He worked as in-house counsel for Sydney Development Corporation the largest software developer in Western Canada.
David has been chair of the Computer Law Section of the Canadian Bar Association. He has handled copyright infringement cases in Supreme Court. He has prepared licencing agreements, distribution contracts, dealer contracts, personal services agreements, rights agreements and nondisclosure agreements.
David acted in the precedent-setting technology case, Gudaitis v. Abacus, in the Court of Appeal. The case established that an appeal judge in chambers has jurisdiction to consider fresh evidence on an application for leave to appeal from an interlocutory order.
David obtained registration of the Power Smart official mark for BC Hydro.
